Article 1 - Definitions

  • BizSiteBuilder: the website builder service offered by Yomera (yomera.com), the operating entity behind bizsitebuilder.com.
  • User: any natural or legal person who creates an account and uses BizSiteBuilder.
  • Platform: the software, website, and all related services of BizSiteBuilder.
  • Workspace: a dedicated environment on the platform linked to one brand identity.
  • AI credits: the unit used within the platform for executing AI actions.
  • Agreement: the agreement between BizSiteBuilder and the user, formed by acceptance of these terms and the chosen subscription.

Article 2 - Applicability

These terms of service apply to all offers, services, and agreements of BizSiteBuilder. By creating an account or using the platform, the user accepts these terms. Deviations are only valid if agreed in writing.

Article 3 - Subscriptions and Payment

  • 3.1 BizSiteBuilder offers subscriptions on a monthly and yearly basis. Current prices are listed at BizSiteBuilder/pricing.
  • 3.2 Payment is made in advance via the available payment methods. Billing occurs automatically at the start of each billing period.
  • 3.3 All prices exclude applicable tax, unless otherwise stated.
  • 3.4 In the event of late payment, BizSiteBuilder reserves the right to block access to the platform until payment is made.
  • 3.5 Monthly AI credits expire at the end of each billing period and do not carry over. Purchased top-up credits do not expire.

Article 4 - Cancellation and Termination

  • 4.1 The user may cancel the subscription at any time via the account settings. The service remains available until the end of the current billing period.
  • 4.2 Upon cancellation, the service remains available until the end of the current billing period. No already-paid amounts will be refunded.
  • 4.3 BizSiteBuilder may terminate an account for violation of these terms, without refund of paid amounts.

Article 5 - Use of the Platform

  • 5.1 The user is responsible for all activities that take place under their account.
  • 5.2 It is prohibited to use the platform for illegal purposes, spreading misleading information, infringing on intellectual property rights of third parties, or circumventing technical limitations.
  • 5.3 The user must respect the workspace limits of the chosen subscription.
  • 5.4 BizSiteBuilder reserves the right to block or remove accounts in case of abuse.

Article 6 - Intellectual Property

  • 6.1 All brand content generated by the user via the platform (logos, text, images) is owned by the user, provided the user has an active paid subscription at the time of creation.
  • 6.2 BizSiteBuilder retains the right to use generated content for improving the platform, unless the user objects via privacy@bizsitebuilder.com.
  • 6.3 The software, the platform, and all underlying technology of BizSiteBuilder are and remain the property of Yomera.
  • 6.4 Users grant BizSiteBuilder a non-exclusive right to process brand data they enter for the purpose of delivering the service.

Article 7 - Availability and Maintenance

  • 7.1 BizSiteBuilder aims for 99.5% annual availability but does not provide an absolute guarantee.
  • 7.2 Planned maintenance will be announced in advance when possible. BizSiteBuilder is not liable for damages resulting from temporary unavailability.
  • 7.3 BizSiteBuilder reserves the right to modify, improve, or discontinue the platform or parts thereof, with a minimum notice period of 30 days for structural changes.

Article 8 - Liability

  • 8.1 The liability of BizSiteBuilder is limited to the amount the user has paid in the three months preceding the damage.
  • 8.2 BizSiteBuilder is not liable for indirect damage, consequential damage, lost profits, or loss of data.
  • 8.3 The user is solely responsible for reviewing and approving AI-generated content before it is published or used.

Article 9 - Applicable Law and Disputes

Disputes should first be worked out between the parties through good-faith consultation. If that fails, the courts of the jurisdiction in which Yomera is established shall have exclusive competence. Applicable law and the specific forum will be added here once Yomera has published them.
